{"id":38039,"date":"2017-11-30T13:57:43","date_gmt":"2017-11-30T13:57:43","guid":{"rendered":"http:\/\/queme.org\/?p=38039\/"},"modified":"2017-11-30T13:57:43","modified_gmt":"2017-11-30T13:57:43","slug":"vietnam-appeal-court-upholds-sentence-on-me-nam-amidst-growing-climate-fear","status":"publish","type":"post","link":"https:\/\/queme.org\/en\/vietnam-appeal-court-upholds-sentence-on-me-nam-amidst-growing-climate-fear\/","title":{"rendered":"Vietnam: Appeal Court upholds sentence on Nguy\u1ec5n Ng\u1ecdc Nh\u01b0 Qu\u1ef3nh amidst a growing climate of fear"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>PARIS, 30<sup>th<\/sup> November 2017 (VCHR) \u2013 The Vietnam Committee on Human Rights (VCHR) strongly protests the condemnation on appeal of prominent blogger and human rights defender <strong>Nguy\u1ec5n Ng\u1ecdc Nh\u01b0 Qu\u1ef3nh<\/strong> (aka M\u1eb9 N\u1ea5m \u2013 Mother Mushroom) to ten years in prison by a court in Nha Trang today. The court upheld the sentence pronounced against her on <a href=\"http:\/\/queme.org\/en\/vietnam-prominent-blogger-nguyen-ngoc-nhu-quynh-sentenced-10-years-prison\/\">29 June 2017<\/a> on charges of <em>\u201cpropaganda against the state\u201d<\/em> (Article 88 of the Criminal Code). Her mother and friends who came to support her were assaulted by plain-clothed security agents outside the courthouse.<\/p>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-38040\" src=\"http:\/\/queme.org\/\/app\/uploads\/2017\/11\/2017-1130a.jpg\" alt=\"\" width=\"600\" height=\"300\" srcset=\"https:\/\/queme.org\/app\/uploads\/2017\/11\/2017-1130a.jpg 600w, https:\/\/queme.org\/app\/uploads\/2017\/11\/2017-1130a-150x75.jpg 150w, https:\/\/queme.org\/app\/uploads\/2017\/11\/2017-1130a-300x150.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>This unfair sentence, which comes on the eve of the <a href=\"http:\/\/queme.org\/en\/vietnam-eu-must-use-upcoming-rights-dialogue-demand-end-crackdown-dissent\/\">EU-Vietnam human rights dialogue<\/a>, was pronounced at the conclusion of a hearing which fell far short of international standards, in particular the right of defence. Last Sunday, Nh\u01b0 Qu\u1ef3nh\u2019s lawyer V\u00f5 An \u0110\u00f4n was suddenly and arbitrarily disbarred by the local Bar Association and prevented from defending her. Moreover, the charges against her are based on vaguely-worded provisions in the Vietnamese Criminal Code which have been widely condemned by the international community as being grossly inconsistent with the United Nations\u2019 International Covenant on Civil and Political Rights (ICCPR) to which Vietnam has been state party since 1982.<\/p>\n<p>The UN Working Group on Arbitrary Detention condemned the detention of Nguy\u1ec5n Ng\u1ecdc Nh\u01b0 Qu\u1ef3nh (20 May 2017) as an act aimed at <em>\u201crestricting her activities as a human rights defender\u201d <\/em>in violation of international law. The VCHR is also gravely concerned by reports from her family that Nh\u01b0 Qu\u1ef3nh\u2019s health has deteriorated in prison.<\/p>\n<p><strong><em>\u201cVietnam accuses her of acts that are nothing other than the basic exercise of the right to free expression. All citizens have the right to care about public affairs and the future of their country\u201d <\/em><\/strong>said VCHR President V\u00f5 V\u0103n \u00c1i.<strong><em> \u201cThis courageous woman\u2019s real \u201ccrime\u201d is that of identifying Hanoi\u2019s strategy of perpetuating a climate of fear, and she is paying a high price for this today\u201d.<\/em><\/strong><\/p>\n<p>As early as <a href=\"http:\/\/queme.org\/en\/bloggers-netizens-behind-bars-restrictions-internet-freedom-vietnam-fidh-vchr\/\">2011<\/a>, Nh\u01b0 Qu\u1ef3nh denounced this fear created by systematic political repression: <strong><em>\u201cthe fear inside each person\u2019s hearts, fear that is slowly, inexorably stifling our vitality and our very future. Dispelling this fear is the most urgent challenge we face\u201d.<\/em><\/strong> Her sentence today, and the 7-year sentence of blogger Nguy\u1ec5n V\u0103n H\u00f3a last Monday are clear examples of this strategy, which is aimed not to sanction real crimes, but to stifle all free expression of legitimate concerns about the problems of Vietnamese society today.<\/p>\n<p>Detained since October 10, 2016, Nguy\u1ec5n Ng\u1ecdc Nh\u01b0 Qu\u1ef3nh is one of the very first human rights defenders in Vietnam to have used the Internet and social media to document human rights violations committed by the Vietnamese authorities. Since her first arrest in 2009, she has relentlessly criticized the Government on a wide range of social and political issues.<\/p>\n<p>In April 2016, she addressed the Government\u2019s mishandling of serious water pollution problems and the subsequent mass fish deaths caused by toxic waste discharged by the Taiwanese company Formosa Plastics in three coastal provinces.
