{"id":41983,"date":"2019-12-03T13:15:08","date_gmt":"2019-12-03T13:15:08","guid":{"rendered":"https:\/\/queme.org\/?p=41983"},"modified":"2021-07-16T07:43:44","modified_gmt":"2021-07-16T07:43:44","slug":"vchr-csw-call-on-mep-not-to-ratify-evfta-without-hr-guarantees","status":"publish","type":"post","link":"https:\/\/queme.org\/en\/vchr-csw-call-on-mep-not-to-ratify-evfta-without-hr-guarantees\/","title":{"rendered":"Civil society urges European Parliament not to ratify EU-Vietnam Free Trade Agreement without firm guarantees on human rights &#8211; Ph\u1ea1m Ch\u00ed D\u0169ng arrested in Vietnam"},"content":{"rendered":"\n<p>BRUSSELS, 3<sup>rd<\/sup>\nDecember 2019 (VCHR) \u2013 At a Conference on <strong>\u201cHuman Rights and the EU-Vietnam\nFree Trade Agreement (EVFTA)\u201d<\/strong>, hosted by MEP Julie Ward (S&amp;D Group) and\norganized by <strong>Vietnam Committee on Human Rights<\/strong> (VCHR) and <strong>Christian\nSolidarity Worldwide<\/strong> (CSW), civil society organizations urged Euro-MPs not\nto ratify EVFTA until Vietnam has taken concrete steps to improve human rights.\n<\/p>\n\n\n\n<p>At the\nconference, VCHR revealed a video message prepared especially for the event by <strong>Ph\u1ea1m\nCh\u00ed D\u0169ng<\/strong>, an independent journalist and prominent dissident in Vietnam. On\n21<sup>st<\/sup> November, just two days after he sent it to VCHR, Ph\u1ea1m Ch\u00ed D\u0169ng\nwas arrested in Vietnam. <\/p>\n\n\n\n<p>The\nconference took place as the European Parliament embarks on a crucial phase of\nnegotiations on EVFTA, one of the most ambitious trade agreements ever\nconcluded between the EU and a developing country, and the Investment\nProtection Agreement (IPA). Today, the EP Human Rights Subcommittee meets to\ndevelop its opinion, and MEPs from across the political spectrum will discuss\ntheir position, to be voted at the beginning of 2020. Signed in June 2019 in\nHanoi, EVFTA and the IPA must be ratified by the European Parliament before\nthey come into force.<\/p>\n\n\n\n<p><strong>VCHR Vice-Chair <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/penelope-faulkner-remarks-on-evfta-ipa-3-dec-2019\/\" target=\"_blank\">Penelope Faulkner<\/a><\/strong><a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/penelope-faulkner-remarks-on-evfta-ipa-3-dec-2019\/\" target=\"_blank\"> said<\/a> that for her committee, EVFTA had <em>\u201ca<\/em> <em>distinct air of <\/em>d\u00e9ja vu<em>\u201d. <\/em>Throughout more than two decades of EU-Vietnam trade relations, with a first agreement in 1995 and a framework Cooperation and Partnership Agreement signed in 2012, the European Commission has systematically played down Vietnam\u2019s abysmal human rights record, insisting that the agreements would give the EU more leverage to press for reforms. <em>\u201cFor the first agreement, we were hopeful. For the second, we were doubtful. For EVFTA, we are plainly not convinced\u201d,<\/em> she told MEPs.<\/p>\n\n\n\n<p>She also\nwarned that the EU was rushing to finalize EVFTA against a backdrop of\nincreasing political repression in Vietnam. Harassments, beatings and arrests\nof human rights defenders, religious followers, bloggers and journalists have\nescalated, harsh prison sentences of 15 \u2013 20 years on trumped-up \u201cnational\nsecurity\u201d charges are frequent. At the same time, Vietnam has adopted a whole\narsenal of laws such as the Criminal Code, the Law on Belief and Religion, the\nPress Law, Cyber Security Law, the law on Access to Information, etc. that\ncriminalise the exercise of human rights. <em>\u201cVCHR and other NGO colleagues\nhave reported regularly on these abuses at the EU-Vietnam human rights dialogues.\nThe EU cannot say they did not know\u201d. <\/em>The EP would betray its core values\nof democracy and human rights by ratifying the agreements without any sign of\ngood will from Hanoi, she said.<\/p>\n\n\n\n<p>In his\nvideo message,<strong> Ph\u1ea1m Ch\u00ed D\u0169ng,<\/strong> a former Communist Party member, observed that\nEVTFA and IPA would benefit Vietnam far more than the EU, given the EU\u2019s trade\ndeficit of 20-25 billion US$ with Vietnam. He described the eight annual\nEU-Vietnam human rights dialogues as <em>\u201cfruitless\u201d,<\/em> with less than 95% of\nthe EU\u2019s recommendations not taken into account, and rejected claims that\nVietnam\u2019s newly-amended Labour Code is a positive step forward. Contrary to what\nhas been said, the Code makes no provisions for the establishment of free trade\nunions. <\/p>\n\n\n\n<a name=\"video-phamchidung\"><\/a><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/KnzZQe3QDw0\" allow=\"accelerometer; autoplay; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\" width=\"650\" height=\"366\" frameborder=\"0\"><\/iframe>\n\n\n\n<p>  <br><\/p>\n\n\n\n<p><em>\u201cThe term \u201cindependent trade union\u201d is not included in the revision of Vietnam\u2019s Labour Code and Trade Union Law\u201d,<\/em> he said. <em>\u201cHanoi considers independent unions as \u201creactionary\u201d because of the impact of Polish the trade union <\/em>Solidarno\u015b\u0107<em> on the fall of communist system in Poland in 1989\u201d. <\/em><\/p>\n\n\n\n<p>Hanoi\u2019s\npromise to consider ratification of ILO Conventions 87 on the right to organise\nand 105 on the abolition of forced labour in 2023-2015 was simply <em>\u201ca trick\u201d<\/em>\nto play for time and demoralise the EU and ILO. <em>\u201cThere is no detailed timeline for ratification or any\nguarantee that Hanoi will meet their commitments\u201d<\/em>,\nhe said.<\/p>\n\n\n\n<p>Ph\u1ea1m Ch\u00ed D\u0169ng concluded his message by calling on the EP to\npostpone ratification of EVFTA and IPA <em>\u201cuntil Vietnam\u2019s regime fulfils its\ncommitments on human rights\u201d,<\/em> and by warning that the trade agreements\nwould not bring an end to Hanoi\u2019s repressive intolerance. <\/p>\n\n\n\n<p><em>\u201cThe regime is likely\nto jail more dissidents after the EU ratifies the EVFTA and IPA. Prominent\ndissidents who oppose EVFTA due to Vietnam\u2019s poor human rights record and those\nwho stand up against China will receive heavy prison sentences\u201d.<\/em><\/p>\n\n\n\n<p>His poignant message predicted his own fate. On 10<sup>th<\/sup> November, <a href=\"https:\/\/queme.org\/en\/vietnam-arbitrary-detention-of-journalist-pham-chi-dung\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Ph\u1ea1m Ch\u00ed D\u0169ng<\/a> sent a Petition to the European Parliament expressing his concerns, and sent the video to VCHR on 19<sup>th<\/sup> November. He was arrested on 21<sup>st<\/sup> November at his home in Saigon (Ho Chi Minh City). He is charged with <em>\u201cmaking, storing or disseminating information, documents, materials and items against the Socialist Republic of Vietnam\u201d<\/em> (Article 117 of the Criminal Code). If convicted, he faces a prison sentence of up to 20 years.<\/p>\n\n\n\n<p>At the Conference, VCHR and FIDH also announced that on Friday 29<sup>th<\/sup> November 2019, they had <strong>filed a formal Complaint to the EU Ombudsman<\/strong> in which they accused the European Commission of \u201cmaladministration\u201d by seeking to conclude EVFTA and IPA without due consideration to human rights, and failing to include monitoring mechanisms in the agreement, despite <a href=\"https:\/\/queme.org\/en\/ep-castigates-vietnam-for-systematic-human-rights-violations\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">a strong resolution adopted by the EP<\/a> in 2018. <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/fidh-remarks-on-evfta-ipa-3-dec-2019\/\" target=\"_blank\">Gaelle Dusepulchre<\/a>, FIDH\u2019s representative to the EU, declared: <em>\u201cthe EU has an immediate<strong> obligation to establish a monitoring and complaints mechanism that can monitor the human rights impacts of the agreement<\/strong>, facilitate people&#8217;s access to appropriate remedies, and provide guarantees of non-repetition. [The mechanism] must offer procedural guarantees, effectively decide on the requests submitted to it and give reasons for its decisions\u201d.<\/em> This is the second complaint filed by FIDH and VCHR to the EU Ombudsman. The <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/eu-vietnam-fidh-and-vchr-submit-a-complaint-to-eu-ombudsman\/\" target=\"_blank\">first complaint<\/a>, submitted in 2014, denounced the EU Commission for failing to conduct a \u201chuman rights impact assessment\u201d which is mandatory in all trade agreements. In 2016, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/european-commission-found-guilty-of-maladministration-for-eu-vietnam-free-trade-agreement\/\" target=\"_blank\">EU Ombudsman Emily O\u2019Reilly<\/a> confirmed that the Complaint was well-founded, and ordered the Commission to carry out an assessment without delay. Although the Commission did not follow her demand on the case of Vietnam, it took FIDH\/VCHR recommendations into account.
