Vietnam continues to adopt laws\nthat restrict the exercise of human rights, and imprisons\npeaceful critics under vague \u201cnational security\u201d provisions. Legislation on administrative detention empowers local\npolice to detain suspected \u201cnational security offenders\u201d\nwithout any due process of law.<\/p>\n\n\n\n<p>Vietnam is\ncurrently receiving millions of dollars from the World Bank, the ADB, UNDP and\na host of donor countries to\nfinance programmes of legal reform. Yet it continues to adopt restrictive laws in violation of the UN\ntreaties to which it adheres. If the international community takes firm steps to ensure that\nthis funding is used to bring domestic legislation into line with international human rights\nlaw, these legal reform programmes could have a real impact on human rights protection in\nVietnam. If not, then international donors could well be helping Vietnam to build a legal stronghold\nthat will stifle fundamental freedoms and rights, and move not towards the rule of law, but\nthe rule by law \u2013 the use of the law to suppress alternative expression and reinforce the\none-Party State.<\/p>\n\n\n\n<p>This report\nexamines the restrictions in Vietnam\u2019s legislation and the inconsistencies with\nthe UN treaties that it has\nratified, and makes recommendations to the Vietnamese government, the international community and member\nstates of ASEAN.
