The resolution was tabled jointly by all seven of the political groups in the 705-member body from across the whole political spectrum <a name=\"footnote1\" class=\"mce-item-anchor\"><\/a><a style=\"text-decoration: none;\" href=\"#note1\">(1)<\/a>.<\/p>\n\n\n\n<p><strong><em>\u201cThe Resolution is\nextremely relevant and timely\u201d<\/em><\/strong> said VCHR President V\u00f5 V\u0103n \u00c1i. <strong><em>\u201cIt sends a strong message to the Vietnamese\nCommunist Party on the eve of its 13th Congress in Hanoi, and reaches out to\nthe new US President Joe Biden to work together with Europe and its member\nstates to press for tangible human rights improvements in Vietnam\u201d<\/em><\/strong>.<\/p>\n\n\n\n<p>The\nResolution, a long and detailed text, denounces a wide range of human rights\nviolations, notably the plight of political prisoners. Vietnam <em>\u201ccurrently holds in detention the largest\nnumber of political prisoners in South-East Asia\u201d<\/em>, it said, adding that the\nEP is <em>\u201cappalled by and condemns the\nescalating crackdown on dissent and increasing violations of human rights in\nVietnam, including the sentencing, political intimidation, surveillance,\nharassment, assaults, unfair trials and forced exiles of political activists,\njournalists, bloggers, dissidents and human rights defenders for exercising\ntheir freedom of expression, in clear violation of Vietnam\u2019s international\nhuman rights obligations\u201d<\/em>.<\/p>\n\n\n\n<p>The Resolution expressed particular concern for the arbitrary arrest and conviction of <strong>Ph\u1ea1m Ch\u00ed D\u0169ng<\/strong>, <strong>Nguy\u1ec5n T\u01b0\u1eddng Th\u1ee5y<\/strong> and <strong>L\u00ea H\u1eefu Minh Tu\u1ea5n<\/strong>, founder and members of the Independent Journalist Association of Vietnam. The three men, who had reported on <em>\u201cgovernment mismanagement and corruption\u201d<\/em>, human rights and democracy, were charged with <em>\u201cmaking, storing, spreading information, materials, items for the purpose of opposing the State.\u201d<\/em> Ph\u1ea1m Ch\u00ed D\u0169ng was sentenced to 15 years in prison, and his two colleagues to 11 years each, followed by three years house arrest. Ph\u1ea1m Ch\u00ed D\u0169ng was also charged with <em>\u201ccooperating foreign media to deliver distorted information\u201d<\/em> after he sent a <a rel=\"noreferrer noopener\" aria-label=\"video message (opens in a new tab)\" href=\"https:\/\/youtu.be\/KnzZQe3QDw0\" target=\"_blank\">video message<\/a> to MEPs urging them to postpone ratification of the EU-Vietnam Free Trade Agreement (EVFTA) pending human rights progress in Vietnam. The video message was sent to VCHR and shown at a <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/vchr-csw-call-on-mep-not-to-ratify-evfta-without-hr-guarantees\/\" target=\"_blank\">Hearing at the EP on 3 December 2019<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-embed-youtube aligncenter wp-block-embed is-type-video is-provider-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Video Message from Pham Chi Dung to European Parliament on EU-Vietnam Free Trade Agreement (EVFTA)\" width=\"618\" height=\"348\" src=\"https:\/\/www.youtube.com\/embed\/KnzZQe3QDw0?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>Denouncing\nharsh detention conditions, lack of access to legal counsel and denial of the\nright to a fair trial, the EP called on Vietnam to <em>\u201cimmediately and unconditionally release Pham Chi Dung, Nguyen Tuong\nThuy and Le Huu Minh Tuan and all other journalists, human rights and\nenvironmental defenders, trade unionists and prisoners of conscience detained\nand sentenced for merely exercising their right to freedom of expression, and\nto drop all charges against them\u201d<\/em>.<\/p>\n\n\n\n<p>The\nresolution said that almost all human rights defenders in Vietnam were detained\nunder <em>\u201crepressive provisions\u201d<\/em> in the Criminal\nCode which are <em>\u201cabusively used to\nsilence, arrest, detain, sentence or restrict the activity of human rights\ndefenders, dissidents, lawyers, trade unions, religious groups and\nnon-governmental organisations, notably those that express critical views of\nthe Government of Vietnam\u201d<\/em>. It called on Vietnam to revise these\nprovisions, notably Articles 117, 118 and 331 of the Code and all other restrictive\nlegislation, such as the Cybersecurity Law or Decree 72 on the Internet. The\nResolution stressed that reform of the Criminal Code is essential for the\neffective implementation of ILO Conventions 98 and 87 which Vietnam has\npromised to ratify. Without this reform, workers would risk imprisonment for\ncriticising state policies in the workplace.<\/p>\n\n\n\n<p>The text reflects\nthe deep dismay of Euro-MPs by the worsening situation of human rights in\nVietnam despite the entry into force of the landmark EU-Vietnam Free Trade\nAgreement (EVFTA). They reminded Vietnam of its binding commitments under the\nEU-Vietnam Partnership and Cooperation Agreement (PCA), which is linked to\nEVFTA. PCA contains a \u201chuman rights clause\u201d which allows for the EU to take <em>\u201cappropriate measures\u201d<\/em> \u2013 including\nsanctions and eventual suspension of the agreements \u2013 <em>\u201cin case of severe and systematic violations of human rights\u201d<\/em>. <\/p>\n\n\n\n<p>During\ntoday\u2019s debate, MEP Maria Arena, Chair of the EP Subcommittee on Human Rights,\ncalled for the immediate suspension of Free Trade Agreement with Vietnam. <em>\u201cThese severe and systematic violations\nexist and will continue to exist\u201d<\/em>, for <em>\u201cVietnam\nwill not change\u201d<\/em>, she said.<\/p>\n\n\n\n<p>Deploring\nwidespread censorship of the Internet and social media activities, the EP noted\nthat <em>\u201cat least two global social media\nplatforms have substantially increased their compliance with Vietnam\u2019s muzzle\nand censorship laws, including through the censorship of peaceful criticism of\nthe State.\u201d<\/em> This refers to the blocking of posts by Facebook and Google\u2019s\ncompany Youtube since April 2020 in response to pressure from the Vietnamese\nauthorities. This is a very serious problem in Vietnam which VCHR has\nrepeatedly denounced. Vice-President <a href=\"https:\/\/youtu.be\/xxm4NtDla4g\">Penelope Faulkner<\/a> said that Facebook\u2019s actions <em>\u201chave\ndramatic consequences for Internet freedom, not only in Vietnam but worldwide. Vietnam\nis the first country in SE Asia \u2013 and possibly in the world, where Facebook has\npublicly acknowledged its compliance with government censorship\u201d<\/em>.<\/p>\n\n\n\n<figure class=\"wp-block-embed-youtube aligncenter wp-block-embed is-type-video is-provider-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Open Interactive Session  Private sector II\" width=\"618\" height=\"348\" src=\"https:\/\/www.youtube.com\/embed\/xxm4NtDla4g?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>The EP Resolution\nraised many key issues including freedom of religion or belief, mandatory\nregistration and repression of religious activities deemed to be <em>\u201ccontrary to national interest, public order\nor national unity\u201d<\/em>; called on Vietnam to recognise independent trade unions;\nto introduce an immediate moratorium on the use of the death penalty; to improve\nunsanitary detention conditions which increase the risk of infection with COVID-19;\nto invite the UN Special Rapporteur on Freedom of Opinion and Expression and\nthe Special Rapporteur on Human Rights defenders to visit Vietnam, and <em>\u201cgive them free and unfettered access to all\nparties they wish to consult\u201d<\/em>.<\/p>\n\n\n\n<p>It also called\nfor the establishment of independent monitoring and complaints mechanisms to\nprovide remedy for victims of violations, and urged the European Commission and\nthe EEAS to conduct a human rights impact assessment to examine the effects of\nEVFTA on human rights in Vietnam. <\/p>\n\n\n\n<p>In\nconclusion, the Resolution called on <em>\u201cEU\nMember States, notably ahead of the 13th Congress of the Communist Party of\nVietnam to strongly voice their concerns regarding the worsening human rights\nsituation in Vietnam; encourages the EU and its Member States to intensify\ntheir international efforts to promote a joint initiative with likeminded\npartners, and particularly with the new US Administration, to work towards\nconcrete human rights improvements in Vietnam at the UN Human Rights Council\u201d<\/em>.<\/p>\n\n\n\n<p>&#8212;<\/p>\n\n\n\n<p><a name=\"note1\"><\/a><a style=\"text-decoration: none;\" href=\"#footnote1\">(1)<\/a> Group of the European People\u2019s Party (Christian Democrats) EPP &#8211; Group of the Progressive Alliance of Socialists and Democrats in the European Parliament (S&amp;D) \u2013 Renew Group &#8211;&nbsp; Group of the Greens \/ European Free Alliance \u2013 (EFA) \u2013 Identity and Democracy Group \u2013 European Conservatives and Reformists (ECR) \u2013 The Left Group in the European Parliament (GUE\/NGL). <\/p>\n","protected":false},"excerpt":{"rendered":"<p>PARIS, 21 January 2021 (VCHR) \u2013 The Vietnam Committee on Human Rights (VCHR) welcomes the strong Resolution adopted by the European Parliament (EP) in Brussels today on the \u201cHuman Rights situation in Vietnam, in particular the case of human rights journalists Pham Chi Dung, Nguyen Tuong Thuy and Le Huu Minh Tuan\u201d.
