{"id":46815,"date":"2022-11-18T07:00:16","date_gmt":"2022-11-18T07:00:16","guid":{"rendered":"https:\/\/queme.org\/?p=46815"},"modified":"2023-03-20T14:59:00","modified_gmt":"2023-03-20T14:59:00","slug":"vietnam-given-failing-grades-by-ccpr","status":"publish","type":"post","link":"https:\/\/queme.org\/en\/vietnam-given-failing-grades-by-ccpr\/","title":{"rendered":"Vietnam given failing grades by UN human rights body"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/queme.org\/app\/uploads\/2022\/04\/FIDH-VCHR-2022.png\" alt=\"\" class=\"wp-image-46574\" width=\"450\" height=\"124\" srcset=\"https:\/\/queme.org\/app\/uploads\/2022\/04\/FIDH-VCHR-2022.png 600w, https:\/\/queme.org\/app\/uploads\/2022\/04\/FIDH-VCHR-2022-300x83.png 300w, https:\/\/queme.org\/app\/uploads\/2022\/04\/FIDH-VCHR-2022-150x41.png 150w\" sizes=\"(max-width: 450px) 100vw, 450px\" \/><\/figure><\/div>\n\n\n\n<p>PARIS, 18 November 2022 (VCHR &amp; FIDH) &#8211; FIDH and VCHR welcome the assessment by the United Nations (UN) Human Rights Committee (CCPR), which gave Vietnam\u2019s government poor grades concerning the implementation of the committee\u2019s recommendations on the death penalty, freedom of expression, and human rights defenders.<\/p>\n\n\n\n<p>On 11 November 2022, the CCPR released <a href=\"https:\/\/queme.org\/app\/uploads\/2022\/11\/INT_CCPR_FUL_VNM_50694_E.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"its report (opens in a new tab)\">its report<\/a> on the follow-up to the Concluding Observations it had adopted on 25 March 2019, upon completion of the review of Vietnam\u2019s third periodic report under the International Covenant on Civil and Political Rights (ICCPR)<a name=\"footnote1\" class=\"mce-item-anchor\"><\/a> <a href=\"#note1\">[1]<\/a> The CCPR had asked the Vietnamese government to provide information on the implementation of recommendations concerning the three above-mentioned priority issues <a name=\"footnote2\" class=\"mce-item-anchor\"><\/a><a href=\"#note2\">[2]<\/a>. <\/p>\n\n\n\n<p>In its follow-up report, the CCPR gave the country an \u2018E\u2019 &#8211; the lowest possible grade<a name=\"footnote3\" class=\"mce-item-anchor\"><\/a> <a href=\"#note3\">[3]<\/a> &#8211; with regard to the government\u2019s implementation of the committee\u2019s recommendations related to freedom of expression. The CCPR expressed concern over the adoption of decrees that further limited the right to freedom of expression and regretted the failure to provide information on steps taken to promote pluralistic media, free from state interference.<\/p>\n\n\n\n<p>With regard to the death penalty, the CCPR also gave an \u2018E\u2019 to the government as a result of its failure to: respect fair trial procedures in death penalty cases; provide information on the commutation of death sentences; and make official data on death sentences available to the public. The increase in the number of death sentences and death row prisoners in recent years, and the lack of information on any measures taken to ensure that capital punishment is only imposed for crimes of extreme gravity involving intentional killing earned the government a \u2018C\u2019 designation.<\/p>\n\n\n\n<p>The CCPR assigned a \u2018C\u2019 to the government\u2019s implementation of the committee\u2019s recommendation on human rights defenders (HRDs). The CCPR regretted the lack of specific information on measures taken to ensure the protection of HRDs and civil society actors, and requested further information on the cases involving imprisoned environmental rights defenders <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/vietnam-blocks-civil-society-participation-in-scrutiny-of-evfta-and-arrests-cso-leaders\/\" target=\"_blank\">Mai Phan L\u1ee3i<\/a>, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/mai-phan-loi-condemned-to-4-years-in-prison\/\" target=\"_blank\">B\u1ea1ch H\u00f9ng D\u01b0\u01a1ng<\/a>, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/vietnam-blocks-civil-society-participation-in-scrutiny-of-evfta-and-arrests-cso-leaders\/\" target=\"_blank\">\u0110\u1eb7ng \u0110\u00ecnh B\u00e1ch<\/a>, and <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/en\/vietnam-sentencing-and-arbitrary-detention-of-environmental-rights-defender-nguy-thi-khanh\/\" target=\"_blank\">Ng\u1ee5y Th\u1ecb Khanh<\/a>.<\/p>\n\n\n\n<p>The CCPR requested the government to provide\ninformation on the three above-mentioned issues as part of its next periodic\nreport to the committee, due in March 2023.<\/p>\n\n\n\n<p>The CCPR\u2019s assessment reflects the findings contained in the <a href=\"https:\/\/queme.org\/en\/vchr-fidh-joint-submission-to-the-un-human-rights-committee-2022\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">follow-up submission<\/a> that FIDH and VCHR made to the committee in July 2022. The joint FIDH-VCHR submission detailed the government\u2019s failure to take any steps towards the implementation of the recommendations made by the CCPR on all three key priority issues.<\/p>\n\n\n\n<p>FIDH and VCHR reiterate their calls on Vietnam\u2019s\ngovernment to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>amend or repeal laws and\ndecrees that are inconsistent with the ICCPR\u2019s provisions;<\/li><li>take concrete steps towards the\nfull abolition of capital punishment;<\/li><li>implement measures for the\nprotection of HRDs;<\/li><li>and immediately and unconditionally\nrelease all those detained for the exercise of their rights to freedom of\nexpression, freedom of peaceful assembly, freedom of association, and freedom\nof religion or belief.<\/li><\/ul>\n\n\n\n<p><br><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><a name=\"note1\" class=\"mce-item-anchor\"><\/a>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br><a href=\"#footnote1\">[1]<\/a> The CCPR monitors state parties\u2019 compliance with the provisions of the ICCPR.
