Government actions to repress protests have included: unnecessary and\/or disproportionate use of force, arrest, detention, prosecution, and other forms of attacks and harassment against protest leaders, participants, and sympathizers.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><a href=\"https:\/\/queme.org\/app\/uploads\/2023\/06\/FIDH-VCHR_807a_Vietnam_a-history-of-violence_2023_EN-3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><img decoding=\"async\" width=\"300\" height=\"424\" src=\"https:\/\/queme.org\/app\/uploads\/2023\/06\/2023-0620-report-foa-eng.jpg\" alt=\"FIDH &amp; VCHR Report &quot;A history of violence, Repression of the right to freedom of assembly in Vietnam&quot; (2023)\" class=\"wp-image-47235\" srcset=\"https:\/\/queme.org\/app\/uploads\/2023\/06\/2023-0620-report-foa-eng.jpg 300w, https:\/\/queme.org\/app\/uploads\/2023\/06\/2023-0620-report-foa-eng-212x300.jpg 212w, https:\/\/queme.org\/app\/uploads\/2023\/06\/2023-0620-report-foa-eng-150x212.jpg 150w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/figure><\/div>\n\n\n\n<p> The report, published in <a href=\"https:\/\/queme.org\/app\/uploads\/2023\/06\/FIDH-VCHR_807a_Vietnam_a-history-of-violence_2023_EN-3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">English<\/a>, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/queme.org\/app\/uploads\/2023\/06\/Fidh-Vchr_807a_Vietnam_une-histoire-de-la-violence_2023_FR.pdf\" target=\"_blank\">French<\/a> and <a rel=\"noreferrer noopener\" aria-label=\"Vietnamese (opens in a new tab)\" href=\"https:\/\/queme.org\/app\/uploads\/2023\/08\/Vietnam807v_VIET_mot-lich-su-day-bao-luc-2023.pdf\" target=\"_blank\">Vietnamese<\/a> also makes detailed and practical recommendations for the government of Vietnam to implement in order to bring the country\u2019s laws and practices related to the right to freedom of peaceful assembly into line with international standards.<\/p>\n\n\n\n<p><strong><em>\u201cThe amendment of all national\nsecurity provisions of the Criminal Code must be the starting point to ensure a\nsafe and enabling environment for the right to freedom of peaceful assembly in\nVietnam. Hanoi should also accelerate the process of adoption of a long overdue\nlaw on demonstrations that complies with international standards,\u201d<\/em><\/strong> said FIDH Secretary-General<strong> Adilur Rahman Khan<\/strong>.<\/p>\n\n\n\n<p><strong>Civil society\u2019s demands met with\nviolence and repression<\/strong><\/p>\n\n\n\n<p>Overwhelmingly peaceful protests in Vietnam\nhave traditionally covered a wide range of issues, from demonstrations for\nreligious freedom to land rights and relations with China. Other salient\nissues, such as the protection of the environment, worker rights, or protests\nagainst restrictive legislation, have also been among other common triggers of\nprotests in Vietnam.<\/p>\n\n\n\n<p>In the absence of national legislation on\npeaceful assembly, a number of Vietnam\u2019s highly restrictive decrees and\nregulations, such as Decree 38 and Circulars 9 and 13, have provided the legal\ntools of repression of those who have exercised, or sought to exercise, the\nright to freedom of peaceful assembly. Most importantly, numerous \u201cnational\nsecurity\u201d provisions of the Criminal Code have been frequently used to arrest,\ndetain, prosecute, and imprison demonstrators and civil society members\ninvolved in activities related to public assemblies. <\/p>\n\n\n\n<p><strong><em>\u201cBrave Vietnamese individuals and\ncommunities from all walks of life have paid a very high price for organizing\nand participating in peaceful demonstrations in defiance of government\nrepression. Foreign governments must apply more pressure on Hanoi to ensure the\nsafe exercise of the right to freedom of peaceful assembly, online and offline,\nbecomes a reality,\u201d<\/em><\/strong> said <strong>VCHR Vice-President\nPenelope Faulkner<\/strong>.<\/p>\n\n\n\n<p>Individuals who were arbitrarily arrested, detained, and prosecuted in connection with their involvement in peaceful assemblies have often faced further abuses, including: denial of the right to a fair trial; disproportionate prison sentences; poor detention conditions; denial of medical care, ill-treatment, and torture in custody; constant police surveillance; and judicial harassment.
